I. General terms and conditions online shop

Sec. 1 Scope of Application

  1. For the business relationship between us (Beauty Hills Cosmetics GmbH) and the buyer in the context of the Beauty Hills online shop, the following general terms and conditions (hereinafter "GTC") apply exclusively in the version valid at the time of the order.
  2. The contract language is German.

§2 Order and conclusion of contract

  1. All our offers are subject to change and non-binding.
  2. After entering his data and clicking on the order button ("Order with obligation to pay"), the customer submits an offer to conclude a purchase contract. The offer is binding for the customer according to § 145 BGB. We are not obliged to accept offers from the customer and can refuse acceptance at any time without giving reasons. In this case, we will inform the customer immediately about the non-acceptance of his offer by e-mail. We accept the offer by sending an order confirmation within 2 working days by e-mail to the customer or by delivering the ordered goods. However, a binding contract can also come about earlier if the customer chooses an immediate payment method and makes the payment when the order is sent. In this case, the contract is concluded at the point in time at which the customer initiates the payment and the corresponding payment service confirms the execution of the payment order.
  3. Beauty Hills sells all goods in normal household quantities only. On the one hand, this includes the number of products in an order and, on the other hand, the number of products in multiple orders that exceed a normal household quantity.
  4. When ordering via our online shop, the ordering process comprises a total of 4 steps. In the first step you select the desired goods. In the second step, enter your customer data including the billing address and, if applicable, a different delivery address. You also choose which beautician you are being treated by. In the third step you choose how you want to pay and which shipping method you want. In the last step, you have the opportunity to check all the information (e.g. name, address, method of payment, ordered items) again and correct them if necessary before you send your order to us by clicking on "Order with obligation to pay". The mandatory fields are marked "*" in the ordering process. These must at least be filled out in order to be able to place an order.
  5. The order text is saved by us. You can print the order text after sending the order, which is done by clicking on "Order with obligation to pay". You will also receive an order confirmation to the email address you provided.


§3 Retention of Title

The delivered goods remain our property until all claims have been paid in full.


§4 Delivery

  1. Delivery will be made to the delivery address you have specified. We currently deliver to Germany, Austria, Belgium, the Netherlands, Luxembourg, Denmark, Poland, Bulgaria, Finland, France, Greece, Ireland, Italy, Croatia, Norway, Portugal, Romania, Sweden, Slovakia, Slovenia, Spain, the Czech Republic and Hungary.
  2. Information about the availability and delivery time is given in the product description.
  3. If we do not have all the ordered goods in stock, partial deliveries are permitted within reasonable limits. Subsequent deliveries are postage free for you.

§5 Prices and shipping costs

  1. All prices are final prices, they include the statutory value added tax.
  2. For shipping within Germany we charge a flat rate of EUR 4,50 (DHL) if the order value is less than EUR 49,00. If the order value is over EUR 49,00, the delivery is free of charge for you. We offer shipments to Austria, Belgium, the Netherlands, Luxembourg, Denmark, Poland, Bulgaria, Finland, France, Greece, Ireland, Italy, Croatia, Norway, Portugal, Romania, Sweden, Slovakia, Slovenia, Spain, the Czech Republic and Hungary via DHL . The following applies to these countries: Shipping costs EUR15,00 for goods with a value of less than EUR149. From a goods value of EUR149, delivery is free of charge.
  3. Deliveries to countries outside the EU may incur additional costs in the form of customs duties or import taxes, which you must bear yourself.

§6 Terms of payment

  1. Payment can be made either by Paypal Plus (Paypal, credit card, direct debit and invoice) or by amazon payment. We reserve the right to exclude individual payment methods. For the other countries to which we deliver, we offer the payment methods PayPal Plus and Amazon Payment. Please note that PayPal Plus does not offer all of the above payment methods for countries that are not Germany. You can see the PayPal Plus payment methods offered during the check-out process.
  2. You can only exercise a right of retention if the claims result from the same contractual relationship.

§7 Warranty (liability for defects), transport damage

  1. The statutory right to liability for defects applies.
  2. Please report transport damage immediately to the deliverer and contact us. The contact options can be seen in the imprint. Please note that failure to complain or contact us has no consequences for your statutory warranty rights. However, they help us to be able to assert our own claims against the transport company.
  3. If the customer acts as an entrepreneur, § 377 HGB applies with regard to the standard of examination.

§8 Right of withdrawal for consumers

Consumers are any natural person who enters into a legal transaction for purposes which can not be attributed primarily to their commercial or self-employed occupation.

In order to comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of withdrawal

If you revoke this contract, we have paid you all payments that we have received from you, including the delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by us have), immediately and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged fees for this repayment. We may refuse repayment until we have received the returned goods or until you have provided proof that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us immediately and in any event no later than fourteen days from the date on which you notify us of the cancellation of this contract. This period shall be deemed to have been observed if you dispatch the goods before the expiry of the period of fourteen days.

You bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Reasons for non-existence and premature expiry of the right of withdrawal:

The right of withdrawal in distance selling does not exist:

In the case of delivery of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.

In the case of delivery of goods that can spoil quickly or whose use-by date would soon be exceeded.

The right of withdrawal in distance selling expires prematurely:

In the case of delivery of sealed goods which, for reasons of health protection or hygiene, are not suitable for return if their seal has been removed after delivery.

In the case of delivery of goods if these were inseparably mixed with other goods after delivery due to their nature.

As part of the "30-day test campaign" you can test the Beauty Hills products risk-free and decide for yourself whether you want to keep them after the period has expired.

You must have a Beauty Hills customer account to take advantage of this promotion. You can create this free of charge on our website. After successfully completing your order, you can view your order under "My Orders" in your account.

If you are not satisfied with your order, you can return part or all of your order. To do this, please select the respective order in your customer account. Please note that the cancellation must be received by us no later than 30 days after placing the order. Returns requests that we receive after this period will unfortunately not be processed. When making a return request, please fill out the comment field and briefly describe the reasons why you would like to return the products.

A product can only be ordered once per customer as part of the test campaign. Return requests for products that have been ordered more than once cannot be processed. 


§9 Procedure for returning the goods

If you make use of your right from §8, the following conditions apply to the return process:
The original packaging is one of the services received, which must be returned in the event of cancellation or withdrawal from the purchase contract. The customer must therefore return the goods in the original packaging when returning them. In the event that the original packaging can no longer be handed over by the customer, he is obliged to compensate for the value (§§ 346 Para. 2, 357 Para. 3 BGB). We therefore strongly recommend that the customer keeps the original packaging if the goods are to be returned. However, the exercise of a cancellation or a right of withdrawal does not depend on whether the goods are returned to us in the original packaging.


§10 Company logo, trademarks, images and texts

  1. Advertisements that contain our company logo, our images and texts may only be placed with prior consent.
  2. The brands assigned to our products may only be used for advertising with our prior consent.

§11 Applicable Law, Place of Jurisdiction

  1. The law of the Federal Republic of Germany applies to the contractual relationships between us and the customer. Excluded from this choice of law are the mandatory consumer protection regulations of the country in which the customer has his habitual residence. The application of the UN sales law is excluded.
  2. If the contracting parties are merchants, the court where Beauty Hills Cosmetics GmbH has its registered office is responsible, unless an exclusive place of jurisdiction is justified for the dispute.

§12 Further customer information

I. We are a member of the Association of Safe and Serious Internet Shop Operators e. V. and have subjected ourselves to the examination criteria there and the out-of-court arbitration board, which is free of charge for our customers.

General terms and conditions of delivery and business

1. General
The following general terms and conditions apply exclusively to the business relationship between Beauty Hills Cosmetics GmbH and the buyer in the version valid at the time of the order. We do not recognize any deviating terms and conditions of the buyer unless we have expressly agreed to their validity in writing.
Verbal agreements must be in writing. Obvious mistakes, writing, printing or calculation errors are not binding for us. Note: Our general terms and conditions listed below apply to all of our products (i.e. cosmetics, cosmetic devices, furnishings and treatment items, etc.) and services.

2. Quantities
All quantities in Buyer's orders are based on information provided by Buyer. A minimum order quantity of 2 pieces per order applies to goods for sale.

3. Prices
The purchase price is the price stated by us or, where this has not been done in detail, the price listed in our price list as it is valid at the time of the order. Price changes are permitted if there are more than 3 months between the conclusion of the contract and the contractual delivery date. The prices do not include the currently valid statutory
Value added tax. Orders with a goods value of €250 or more (excluding VAT) are shipped free of charge. For orders with a lower value of goods, we charge proportionate postage, packaging and shipping costs, but at least €8,50. Bank chargebacks, which we have in the event of insufficient funds in the buyer's account for the non-execution of direct debit orders, objection
or non-cashing of checks from banks, savings banks or other financial institutions are to be replaced by the customer and can be transferred directly by the customer or billed by Beauty Hills Cosmetics GmbH with the next order. Beauty Hills calculates the costs incurred plus processing fees according to expenditure, but at least the amount of 15 €.

4. Payment and Settlement
The cosmetic goods are payable in advance with a 2% discount, direct debit with a 3% discount or cash on delivery without deduction of discount if the net order value is over €250, no older invoice is unpaid and no other payment terms have been agreed in writing. Services, device orders or other non-cosmetic goods and services, such as advertising materials and seminar fees, are excluded from the discount. From a net order value of €395, the invoice amount can also be paid by direct debit within 30 days without any discount being deducted. The receipt of payment by us or on our account is decisive. If the buyer defaults on payment, we are entitled to charge interest on arrears at a rate of 5% above the base interest rate. If the buyer is a merchant, the (default) interest rate is 8% above the base rate. We are entitled to demand reminder fees of €15 per letter for each reminder. If a direct debit is returned to us - for whatever reason - then the right to a cash discount expires and we calculate it within the dunning procedure. If, after the conclusion of the contract, a significant deterioration in the financial situation of the buyer becomes apparent, which jeopardizes our claim to the consideration, we can, if there is an obligation to perform in advance, refuse our service until the consideration has been rendered or security has been provided to us. If, after a reasonable period of time set by us, the buyer is neither willing to perform contemporaneously nor to provide security, we have the right to withdraw from the contract. Offsetting against counterclaims by the buyer is only permitted if these are recognized by us as existing and due or have been legally established. The buyer is only authorized to exercise a right of retention insofar as his counterclaim is based on the same contractual relationship. The goods remain the property of Beauty Hills Cosmetics GmbH until full payment has been made. Installment purchase: If more than 2 installments are in arrears with an installment purchase granted by us, the installment payment agreement will be declared void and the total claim for a one-off payment will become due.

5. Delivery Obligations
Our obligation to deliver only exists if the buyer runs a cosmetics institute, proves his professional qualifications for this and attends a seminar organized by us once a year. The reason for this is, on the one hand, to ensure that our products and our treatments are used correctly by the respective end user and, on the other hand, to bring the knowledge of the active ingredients and mode of action of our products up to date so that the end user/ in proper and professional advice by the buyer. An order is only accepted by Beauty Hills Cosmetics GmbH through delivery.

6. Acceptance of the delivery item
If the buyer refuses acceptance after the expiry of a reasonable grace period set for him or expressly declares that he does not want to accept acceptance, we can withdraw from the contract and demand compensation. A flat rate of 33% of the order amount can be demanded as damages. The buyer is free to prove that we have suffered no damage or a significantly lower damage. If, in an individual case, we incur exceptionally high damage that significantly exceeds the flat rate for damage, we are entitled to assert this damage.

7. Passing of Risk
The place of performance for our delivery obligation is the respective business premises of the buyer. The shipment of the delivery item takes place at the request of the buyer. Unless otherwise agreed, we are free to choose the shipping route and means. The delivery item is shipped at the buyer's risk. If the dispatch is delayed due to the behavior of the buyer, the risk is already transferred to the buyer with the notification that the goods are ready for dispatch.

8. Retention of Title
Delivered goods remain our property (reserved goods) until full payment (in the case of checks until their unconditional encashment).

9. Notification of Defects, Warranty
The buyer must inspect the delivery item immediately after receipt with the care that can be expected of him under the given circumstances and immediately complain in writing about any defects that can be identified and report incorrect deliveries in writing within 8 days of receipt of the goods. If a defect appears later that cannot initially be identified, this must be reported in writing immediately after its discovery. If the buyer omits the complaint, the delivery is deemed to have been approved. Insofar as there is a defect for which we are responsible, we are entitled to choose between remedying the defect or making a new delivery. Damage caused by improper handling is not subject to our warranty. The warranty obligation is one year from the transfer of risk (item 7). The warranty always relates to an individual item and does not extend to an assortment, equipment or system in the event of defects or defects in an individual item. For the rest, the statutory provisions of the German Civil Code and our complaints guidelines apply to the warranty, according to which a complaints form must be filled out in full. Returns of goods must be agreed in advance.

10. Company Logo and Trademarks
Advertisements that contain our company logo may only be placed with prior consent. The brands assigned to our products may only be used for advertising with our prior consent.

11. Channel of Distribution
Our products may only be sold to end users who have previously received a skin analysis and individual advice on the effectiveness and correct use of the products. This is to ensure that, on the one hand, end users only receive products/treatments that are tailored to their respective skin type/condition and, on the other hand, unwanted skin reactions are avoided. Selling to resellers is not permitted for the reason stated in section 5.

12. Internet
Our products may only be sold via our own or third-party online shops with our prior written consent. If the buyer operates an online shop in addition to his cosmetics institute, this may only be available to end users who have previously received a skin analysis and individual advice from the buyer about the effectiveness and correct use of the products. The sale of cabin goods and samples is not permitted. Furthermore, the active sale and delivery of our products are only permitted in Germany. The online shop must be appealing and of high quality. In this regard, the manner in which the products are represented and presented must satisfy our high brand image. Furthermore, a fast page structure, easy navigation, a secure payment system and a speedy delivery of the ordered products must be guaranteed. If the buyer has other products in his online shop in addition to our products, a clear separation and differentiation from our products must be ensured. A sale via eBay and other auction platforms on the Internet cannot meet the aforementioned principles and is therefore not permitted. The buyer is also not permitted to use a derogatory domain name for his online shop. In addition, the advertising of our products/treatments on the Internet requires prior verification and subsequent written approval by us. This is intended to ensure compliance with regulations relating to competition law in particular
